By accessing or using ARC Raiders ("the Game"), our website, or any related services ("Services"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Game and Services.

2. Description of Service

ARC Raiders is a free-to-play, cooperative third-person shooter game developed and published by Embark Studios. The Services include the Game, official websites, forums, and any other services provided by Embark Studios related to ARC Raiders.

3. Account Registration and Security

To access certain features of the Game, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access to your account
• Notify us immediately if you discover or otherwise suspect any security breaches related to the Services
• Take responsibility for all activities that occur under your account

4. License Grant and Restrictions

6. Virtual Items and Currency

ARC Raiders may include virtual currency, items, or other digital assets ("Virtual Items"). You acknowledge that:

• Virtual Items have no real-world value and are not redeemable for any sum of money
• Virtual Items are licensed, not sold, to you
• Embark Studios has the right to manage, regulate, modify, or eliminate Virtual Items at any time
• All purchases of Virtual Items are final and non-refundable
• The transfer of Virtual Items between accounts is prohibited unless expressly permitted

7. Intellectual Property Rights

The Services, including all content, visual elements, graphics, design, compilation, magnetic translation, digital conversion, and other matters related to the Services are protected under applicable copyrights, trademarks, and other proprietary rights. The copying, redistribution, use, or publication by you of any such matters or any part of the Services is strictly prohibited.

8. Termination

These Terms are effective until terminated by either you or Embark Studios. You may terminate these Terms at any time by permanently discontinuing use of the Services. Embark Studios may terminate these Terms, or suspend or terminate your access to the Services, at any time for any reason, including if we suspect that you have failed to comply with any provision of these Terms.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, EMBARK STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

IN NO EVENT SHALL EMBARK STUDIOS, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Embark Studios and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your use of the Services or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Stockholm, Sweden for any actions for which we retain the right to seek injunctive or other equitable relief.

13. Changes to Terms

Embark Studios reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
